Ever since Typhoon Morakot struck over two years ago, citizen journalist ‘Jialan Report’ has been following the situation in Jialan Village, and has already notched up 84 reports.  On the 18th of December, disaster victims from Jialan Village and The Legal Aid Foundation held a joint press conference to announce to the world their plans to bring a compensation lawsuit against the government. Residents stress that after super-typhoon Haitang struck Taiwan in 2005, the area was left with only temporary flood prevention measures, and that this was the main reason for the catastrophe which befell the area. Locals believe that the investigation report carried out by The Control Yuan explicitly indicates that fatal errors of judgment were made by Taitung County Government, the Council of Agriculture and the Executive Yuan. However, these government bodies have continuously passed the buck, denying any responsibility. As a result, local indigenous people have been forced to seek legal assistance from The Legal Aid Foundation and formally file a compensation lawsuit against the government at the district court. All involved dearly hope that the judicial system will give the local indigenous people a fair hearing.

堅固的堤防，是造成八八重大災難的最主要原因。居民認為，監察院的調查報告已經明確指出台東縣政府、農委會、行政院有各種疏失，但政府機關還是互相踢皮球、推卸責任，因此受災族人委託法律扶助基金會律師團正式向台東地方法院提起國家賠償訴訟，期待司法還給受災族人一個公道。
